Israel’s offensive against the Gaza Strip, Operation Protective Edge, killed 2,104 Palestinians, including 495 children, forcibly displaced 250,000 Palestinians, rendered 100,000 homeless, destroyed 16,800 homes, destroyed Gaza’s sole power plant, among a litany of destruction. During the course of the 52-day operation, Israel targeted six UNRWA schools providing shelter to thousands of Palestinians. Hamas killed 64 Israeli soldiers and 5 civilians. The extent of the harm has raised significant questions around Israel’s culpability for war crimes and has increased pressure on the Palestinian leadership to accede to the Rome Statute to pursue International Criminal Court (ICC) prosecution. This panel will explore the relevant legal questions under international criminal law as well as the political issues related to ICC accession by Palestine.
